Government’s Decree on management and exploitation of aviation port released
Principles on management and exploitation of aviation port and airport (hereafter called airport), conditions and procedures of opening and closing airport, control over activities conducted at airport and nearby areas, and use of civil-military combined airport are provided in Decree No.83/2007/ND-CP dated May 25, 2007.Those who receive Certificate on airport exploitation have to send their request to Vietnam Aviation Administration in order to open airport. Within 30 days from the date of document submission, Vietnam Aviation Administration will carry out appraisal and report the result to Ministry of Transport. Within 5 days after receiving the report, Minister of Transport is responsible for submitting decision on opening airport. Individuals and organizations in need of land use at airport should send request document to Aviation Port Authority. In 90 days from the date of receiving sufficient eligible document, the Aviation Port Authority is obliged to appraise the documents and report to Vietnam Aviation Administration, issue decision of land allocation, sign contract with individuals and organizations renting land. Legal capital required for enterprises doing business in international airport is 100 billion VND and domestic airport 30 billion VND. Regarding supplier of aviation services which is not an enterprise operating at airport, legal capital required is 30 billion VND for doing business at international airport and 10 billion VND at domestic airport. The Decree also provides List of aviation services at airport.
The Decree was posted on Official Gazette on June 16, 2007 and would take effect from July 1, 2007. The Government’s Decree Ni.29/CP dated April 2, 1997 stipulating cooperation mechanism of state agencies over civil airport.
