Regulation on hygiene and safety checking for imported foodstuff

On March 29, 2007, Ministry of Health issued regulation on state inspection of quality, hygiene and safety of imported foods in Decision No.23/2007/QD-BYT, apply to organizations, individuals who imports foodstuff for domestic consuming.

Owner of imported foodstuff has to register state hygiene and safety checking at least 5 days before goods come to border gate and pay checking fee, charge. If batch of goods meet imported requirements, inspection agency will grant Certificate of passed imported foodstuff requirements or Announcement on checking record of this batch (following form of this decision). If the foodstuff did not meet imported requirements, inspection agency will send Announcement of fell imported foodstuff requirements enclose with Test result note to the owner of goods and customs office where the goods arrived, and send report to Agency for Safety Hygiene Foodstuff (Ministry of Health). This Agency will issue suitable decision with time-limit not exceed 15 days (exclude public holiday). Dossier of checking registration include: Application for state inspection of safety foodstuff; legal photocopy of basic standards by Promulgated Standard of Products Regulations is attached with Decision No. 42/2005/QD-BYT dated December 8, 2005; set of dossier for customs procedures; healthy certificate by authority state agency of original nation for foodstuff source from animal and plants which over sterilized processing (if necessary); photocopy of testing result note; necessary related document that can be apply to use lighten inspection method, document checking only (if have). Foodstuff taking with individuals to consume less than amount which have to pay imported tax; foodstuff is humanitarian present, is good in diplomatic bag, consular bag by law, admit temporarily re-export food; transited food; food is test sample; food is sample of participating fair; food by Vietnamese enterprises do out work for foreign owner to export only, etc. will not have to take state inspection.

The Decision was published on the Official Gazette on May 9, 2007 and comes into effect 15 days afterward; abrogate the Decision No. 1370/1997/QD-BYT dated July 17, 1997 on “Regulation on state inspection of hygiene and safety for imported foodstuff”.
