Regulation on hiring foreign construction consultants

Ha Noi (VNA) - Hiring foreign consultants for construction projects in Viet Nam must fall in line with principles of competition, cost efficiency and effectiveness under a regulation approved recently by Prime Minster Nguyen Tan Dung.

Under the regulation, renting foreign consultants to draw up construction plans in cities and provinces at central level and the different types of renting will be drawn up by local Chairmen of People's Committees.

Meanwhile, the Minister of Construction will decide on rules for renting foreign consultants and types of renting for construction projects to be submitted to the PM for approval.

Concerning hiring foreign experts as consultants, the regulation requires that the experts must hold a practising certificate on construction consultancy, have a minimum of five year experiences operating in this field with consultancy services provided for at least three similar projects.

In terms of renting foreign organisations as consultants, these businesses must hold an operation licence, have legal status and must meet financial capacity requirements.

They are also required to have enough qualified experts with experience in at least three similar construction projects to which they were main contractors.

Renting foreign consultants must follow a contract signed between projects' investors or planning agencies and consultancy contractors. Foreign consultancy contractors are not allowed to purchase contracts in any form.

Under the regulation, during the process of carrying out consultancy services, foreign contractors must abide by Viet Nam's laws on construction standards.-Enditem
